Day 2 Takeaway – Harvard Mediation Intensive

A few reflections that truly resonated with me on day two.
1. Preventative mediation
Integrate mediation clauses into the contracts and start mediation before dynamics harden and problems escalate. Prevention is always cheaper, faster, and more humane than repair.
2. Mediators are providers of subjective value
We work on two axes: x —) objective value and y —) relational value.
On the 45 degree axis lies the subjective value, i.e the space where trust, understanding, and alignment grow.
The higher we get on this, the more parties move into the zone of sustainable partnership, where solutions become not just possible, but long-lasting.
Our role as mediators is to guide parties into that zone, towards higher subjective value and durable collaboration.
3. The power of transparency
Mediation only reaches its full potential when all relevant parties are at the table and all information is available. When something is missing, go as far as you can but then bring in the people and data needed to enable real decision-making.
Transparency is not a nice-to-have, it’s the foundation of clarity and sustainable agreements.
